1. Acceptance of Terms

By accessing, browsing, or using OpenCareerAI ("the Service"), operated by OpenCareerAI ("the Company," "we," "us," or "our"), you ("the User," "you," or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service in their entirety. If you do not agree to these terms, you must immediately cease all use of the Service. Your continued use of the Service constitutes acceptance of these terms and any future amendments published on this page.

2. Eligibility

• You must be at least 16 years of age to create an account and use the Service.
• By registering, you confirm that the information you provide is accurate and complete.
• The Service is intended primarily for users based in India, though it is accessible globally.
• If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Description of Services

OpenCareerAI is an AI-powered career intelligence platform. The Service includes, but is not limited to:

• AI Career Guidance: Personalised career path recommendations and skill gap analysis powered by large language models.
• Mock Interviews: Voice-AI proctored and practice interview sessions with real-time scoring and feedback.
• Coding Practice: DSA problem sets with a sandboxed code editor, AI code reviews, and mastery paths.
• Resume Tools: AI-assisted resume building, ATS scoring, and optimisation suggestions.
• Job Search: Aggregated job listings from third-party sources with AI-powered matching.
• Recruiter Platform: Tools for verified recruiters to post jobs and view opted-in candidate profiles.

The Service is a supplementary tool to assist your career development. It is not an employment agency, recruiter, staffing service, or a substitute for professional career counselling.

4. User Accounts

• You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You may not create multiple accounts, share accounts, or transfer your account to another person.
• Providing false, misleading, or fraudulent information at registration or in your profile is grounds for immediate termination.
• We reserve the right to suspend or permanently terminate any account at any time, for any reason, with or without notice, at our sole discretion.

5. User Content & Intellectual Property

Ownership: You retain full ownership of all content you upload to the Service, including resumes, profile information, and code submissions ("User Content").

Licence Grant: By uploading User Content, you grant OpenCareerAI a non-exclusive, worldwide, royalty-free licence to store, process, transmit to third-party AI providers, and use your User Content solely for the purpose of providing and improving the Service to you. This licence terminates when you delete your account and the 30-day retention period expires.

Our Intellectual Property: All design, software, algorithms, logos, trademarks, and technology of OpenCareerAI are the exclusive property of OpenCareerAI and are protected by applicable Indian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Service without our express written consent.

6. AI-Generated Content & Disclaimer

The Service uses large language models and AI systems — including Anthropic Claude, OpenAI GPT-4o-mini, and Google Gemini — to generate resumes, interview feedback, career recommendations, code reviews, and other content. All AI-generated content is provided for informational and guidance purposes only and does not constitute professional career counselling, legal advice, or any other form of professional advice.

• AI-generated content may contain inaccuracies, errors, omissions, or biases.
• You are solely responsible for reviewing, editing, and verifying all AI-generated content before using it in any professional context.
• Mock interview scores are AI-generated estimates based on your responses. They are not a guarantee of your performance in actual interviews.
• ATS scores are algorithmic estimates and may not reflect the behaviour of any specific employer's actual ATS system.
• We make no warranties regarding the accuracy, suitability, or fitness of AI-generated output for any particular purpose.

7. Third-Party Services & Data Processors

By using the Service, you acknowledge that your data may be transmitted to and processed by the following third-party providers, each governed by their own terms and privacy policies:

• Anthropic (Claude API): Processes user text for primary AI features including resume optimisation and career guidance.
• OpenAI (GPT-4o-mini): Used for high-volume AI tasks such as job matching and skill analysis.
• Google (Gemini API): Powers mastery content generation and job matching features.
• Razorpay: Payment gateway for subscriptions and add-on purchases. All card data is processed exclusively by Razorpay under PCI-DSS and RBI compliance. We never store your card details.
• Adzuna API: Third-party job search aggregation. Search queries are sent to Adzuna's API.
• Resend: Transactional email delivery (OTPs, receipts, notifications).
• Judge0 CE: Open-source sandboxed code execution environment for the coding practice feature.
• Google OAuth: Optional sign-in via Google account.
• LinkedIn OAuth: Optional sign-in via LinkedIn account.
• Web Speech API: Browser-native speech recognition used for voice-based mock interviews. Voice audio is processed locally in your browser and is not sent to our servers.

We are not responsible for the terms, policies, data handling, outages, or conduct of any third-party provider.

8. Recruiter Platform Terms

• Access to the Recruiter Platform is subject to verification and approval by OpenCareerAI.
• Recruiters must post only genuine, current job openings and must not post misleading, fraudulent, or discriminatory listings.
• Recruiters may view candidate profiles and statistics only for candidates who have explicitly opted in to recruiter visibility.
• Recruiters may not use candidate data obtained through the platform for any purpose other than evaluating candidates for the specific posted roles.
• Recruiters may not scrape, export, or bulk-download candidate data.
• Violation of recruiter terms will result in immediate account termination and may be reported to relevant authorities.

8.1 Job Scam & Fraud Disclaimer

• While we take steps to verify recruiters and moderate job listings, we cannot guarantee the legitimacy of every recruiter or job posting on our platform.
• Third-party job listings aggregated from sources such as Adzuna are not verified by us for accuracy, currency, or legitimacy.
• Never pay money to any recruiter, employer, or agent for applications, training, or "registration fees." Legitimate employers do not charge candidates.
• Report suspicious listings using the Report button on any job card, or email us at support@opencareerai.com.
• OpenCareerAI is not liable for any loss resulting from interactions with recruiters, employers, or third parties found through job listings on this platform.

9. Prohibited Conduct

You agree not to:

• Create fake profiles, falsify your qualifications or work history, or impersonate another person or entity.
• Submit spam job applications or use automated tools to apply to jobs en masse.
• Scrape, crawl, or otherwise extract data from the Service using automated means.
• Reverse-engineer, decompile, or attempt to extract source code from the Service.
• Use the Service for any unlawful, fraudulent, or malicious purpose.
• Share or publicly disclose proctored exam questions or proprietary content from the coding practice or interview sections.
• Harass, abuse, or threaten other users via the messaging or social features.
• Circumvent usage limits, payment mechanisms, or access controls.
• Resell, sublicense, or commercially exploit the Service or its AI-generated output without our express written consent.
• Upload malicious code, viruses, or any content intended to harm the Service or its users.

Violations may result in immediate account termination without refund and may be reported to law enforcement.

10. Subscription, Billing & Payments

10.1 Billing

• Paid plans are billed through Razorpay in Indian Rupees (INR). All prices are inclusive of applicable taxes unless stated otherwise.
• Subscriptions auto-renew at the end of each billing cycle via Razorpay's recurring payment system unless you cancel before the renewal date.
• It is your sole responsibility to cancel before the next renewal date to avoid being charged for the following cycle.
• Add-on credit packs are one-time purchases and do not auto-renew.

10.2 Refund & Cancellation

10.3 Pricing Changes

• We reserve the right to change pricing, plan features, or usage limits at any time.
• Price changes apply to new billing cycles and will be communicated in advance.

11. No Employment or Outcome Guarantee

OpenCareerAI does not guarantee, promise, or imply any specific outcome, including but not limited to job interviews, job offers, employment, salary increases, promotions, or ATS pass rates. Your career outcomes depend entirely on your qualifications, effort, market conditions, and circumstances beyond our control.

12. Service Availability & Modifications

We reserve the right to modify, update, suspend, or discontinue any part of the Service at any time, with or without notice, at our sole discretion. The Service may experience downtime, errors, or data loss. We shall not be liable for any loss or inconvenience arising from service unavailability or modifications.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. Your use of the Service is at your sole risk.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL OPENCAREERAI, ITS FOUNDERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, including loss of profits, revenue, data, job opportunities, or other intangible losses, arising out of or in connection with your use of the Service, any AI-generated content, any third-party listings, or any service interruptions.

Our total cumulative liability for all claims shall not exceed the amount you paid to us in the three months preceding the claim, or ₹500 (INR), whichever is less.

15. Indemnification

You agree to indemnify, defend, and hold harmless OpenCareerAI, its founders, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you upload or generate; or (e) any misrepresentation in your profile.

16. Termination & Account Deletion

16.1 Termination by Us

We may terminate or suspend your account at any time, for any reason or no reason, with or without notice. Termination for policy violations will be without refund.

16.2 Deletion by You

You may delete your account at any time from the Settings page. Upon deletion, your account is deactivated immediately. Your data is retained for 30 calendar days to allow for accidental recovery, fraud prevention, and legal compliance. After 30 days, your data is permanently and irreversibly deleted. Payment records may be retained for up to 7 years as required by Indian financial regulations.

16.3 Survival

Sections 5, 6, 11, 13, 14, 15, and 17 survive termination of these Terms.

17. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Any dispute shall first be attempted to be resolved through good-faith negotiation for 30 days.
• If negotiation fails, disputes shall be resolved by binding arbitration in Bengaluru, Karnataka, India, under the Arbitration and Conciliation Act, 1996.
• You waive any right to participate in class actions or class-wide arbitration.
• The exclusive jurisdiction for disputes not subject to arbitration shall be the courts of Bengaluru, Karnataka, India.

18. Changes to These Terms

We may update these Terms at any time. The updated version will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

19. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
